A hearing will be held before the Alabama Commissioner of Insurance at the offices of the Alabama Department of Insurance, 201 Monroe Street, Suite 1700, Montgomery, Alabama, as follows:

On August 16, 2000, beginning at 10:00 AM:

  • Revision of Regulation No. 91, to implement the Alabama Long-Term Care Insurance Policy Minimum Standards Act (Article 3, Chapter 19, Title 27, beginning with Section 27-19-100, Code of Alabama 1975), The proposed revisions will cause the regulation to become substantially similar to the Long-Term Care Insurance Regulation developed by the National Association of Insurance Commissioners. The proposal is for the revisions to take effect on January 1, 2001. (52 pages)

On August 22, 2000, beginning at 10:00 AM:

  • Revision of Regulation No. 54, regarding notification to the Commissioner of disciplinary action by other states or federal agencies and of criminal or civil actions against insurance companies, insurance agents, brokers and other licensed entities. The proposed revisions would incorporate within Regulation No. 54 the requirements currently contained in Regulation No. 54A, would add a requirement to provide notice of the filing of a class action lawsuit against a licensee, and would provide an exception to the notification requirement of penalties imposed due to untimely filings of reports, statements or notices. The effective date of the proposed revisions to Regulation No. 54 is October 1, 2000. (5 pages)

  • Repeal of Regulation No. 54-A, regarding notification to the Commissioner of criminal or civil actions against insurance agents or brokers. The provisions currently within Regulation No. 54-A are being incorporated into proposed revisions to Regulation No. 54. The proposed effective date of the repeal of Regulation No. 54-A will coincide with the effective date of proposed revisions to Regulation No. 54. (1 page)

  • Adoption of proposed new Regulation No. 121, setting forth guidelines to be followed by the Alabama Department of Insurance in granting or denying consent under the Violent Crime Control and Law Enforcement Act of 1994, 18 U.S. Code §§ 1033-1034. The proposed effective date of Proposed Regulation No. 121 is October 1, 2000. (15 pages)

Any person wishing to submit testimony at said hearings is requested to submit said testimony in writing to the Alabama Department of Insurance, Attention: Legal Division, Post Office Box 303351, Montgomery, Alabama 36130-3351, at least one week in advance of the hearing. Any written submission of testimony prior to the hearing will not preclude anyone from making an oral or written presentation at the hearing.
