A hearing will be held before the Alabama Commissioner of Insurance at 10:00 AM on June 6, 2001, at the offices of the Alabama Department of Insurance, 201 Monroe Street, Suite 1700, Montgomery, Alabama, as follows:

  • Revision of Regulation No. 116, known as the Alabama Small Employer Allocation Program Regulation. Evidence and testimony will be received and considered relative to market data and experience reports containing information on market penetration, premium rate trend and claims trend under health benefit plans offered by carriers, along with other applicable information, to review the rating adjustments based on health characteristics permitted in Subdivision (5) of Subsection (a) of Section 5 of the regulation. Based on this evidence and testimony, the Commissioner will consider a proposed revision to Regulation 116 to increase the allowed rating adjustments based on health characteristics from 20% above or below the insurer’s base rate to 35%. The name of the regulation will also be changed to the Alabama Small Employer Health Insurance Program Regulation. The revisions would take effect on July 1, 2001, upon the concurrence of the State Board of Health and upon being filed as a public document in the office of the Secretary of State for ten days.   • Revision of Regulation No. 122, so as to set forth the requirements governing the treatment of nonpublic personal financial information about individuals to comply with Title V of the Gramm-Leach-Bliley Act (15 U.S. Code §§ 6801-6827). The proposed effective date is July 1, 2001. (43 pages)

  • Adoption of proposed new Regulation No. 123, to be known as the Rates and Forms Filing Requirements Regulation. The purpose of the proposed new regulation is to set forth requirements to be followed in the filing of rates and policy forms, with the desired result of improving the speed to market of policy forms and rate filings. The proposed effective date is July 1, 2001. (6 pages)

  • Repeal of Regulation No. 89, which became effective January 1, 1990, to implement transitional requirements for the conversion of Medicare supplement insurance benefits and premiums to conform to repeal of the Medicare Catastrophic Coverage Act. The provisions of this regulation have been superceded by revisions already in place in Regulation 71. The repeal of Regulation 89, which is proposed to become effective immediately. (9 pages)

Any person wishing to submit testimony at said hearing is requested to submit said testimony in writing to the Alabama Department of Insurance, Attention: Legal Division, Post Office Box 303351, Montgomery, Alabama 36130-3351, at least one week in advance of said hearing. Any written submission of testimony prior to the hearing will not preclude anyone from making an oral or written presentation at the hearing.
