Notice of Regulation Hearing

Notice is hereby given that a hearing will be held at 10:00 AM on Thursday, June 11, 2009, at the offices of the Alabama Department of Insurance, 201 Monroe Street, Suite 1700, Montgomery, Alabama, as follows:

 

Revision of Regulation No. 71 [Chapter 482-1-071], which sets forth new language to the Medicare Supplement regulation to comply with the Medicare Improvements of Patients and Providers Act of 2008 and the Genetic Information Nondiscrimination Act of 2008, together with other proposed revisions designed to cause this regulation to be substantially similar to the Model Regulation developed by the National Association of Insurance Commissioners.  (112 pages)

 

Revision of Regulation No. 78 [Chapter 482-1-078], which sets forth requirements for life insurance payments, to add the inclusion of annuities and annuity payments language to this regulation.  (5 pages)

 

Repeal of Regulation No. 121 [Chapter 482-1-121], which sets forth procedures governing persons subject to 18 U.S.C. § 1033, will be superseded by the provisions in new proposed Regulation No. 146 [Chapter 482-1-146]. (17 pages)

 

Adoption of new proposed Regulation No. 146 [Chapter 482-1-146], which sets forth requirements and procedures for furnishing individual criminal history information and for actions based on that information in determining whether to issue or renew a license, the applicability of 18 U.S.C. § 1033, and whether to grant consent required under 18 U.S.C. § 1033(e).  (23 pages) 

 

Any person wishing to submit testimony at said hearing is requested to submit said testimony in writing to the Alabama Department of Insurance, Attention: Legal Division, Post Office Box 303351, Montgomery, Alabama 36130-3351.  Any written submission of testimony prior to the hearing will not preclude anyone from making an oral or written presentation at the hearing.
