Notice is hereby given that a hearing will be held at 2:00 p.m. Central Time, on Wednesday, June 14, 2017, in the offices of the Alabama Department of Insurance, 201 Monroe Street, Fifth Floor Conference Room, RSA Tower, Montgomery, Alabama, as follows: 

 

Amendment to Section 3 of Insurance Regulation No. 71 [Rule 482-1-071-.03], which sets forth the applicability and scope of the regulation.  The amendment merely adds the words “this chapter,” which were obviously omitted in the original version.  The amendment will become effective June 24, 2017.  (2 pages)

 

Amendment to Section 7 of Insurance Regulation No. 71 [Rule 482-1-071-.07], which sets the minimum benefit standards for pre-standardized Medicare supplement benefit plan policies or certificates issued for delivery prior to March 25, 1996.  The amendment merely deletes the specific dollar amount for the Medicare Part B deductible, which changes from year to year.  The amendment will become effective June 24, 2017.  (6 pages)

 

Amendment to Section 9-1 of Insurance Regulation No. 71 [Rule 482-1-071-.09-1], which sets the standards applicable to all Medicare supplement policies delivered or issued for delivery on and after June 1, 2010.  The amendment adds language necessary to introduce the redesigned Plan G High Deductible.  The amendment will become effective January 1, 2020.  (11 pages)

 

Adoption of new Section 9-2 of Insurance Regulation No. 71 [Rule 482-1-071-.09-2], to set the standards applicable to all Medicare supplement policies issued for delivery on and after January 1, 2020.  The new section is substantially similar to the NAIC model regulation.  The new section will become effective January 1, 2020.  (4 pages)

 

Amendments to Section 17 of Insurance Regulation No. 71 [Rule 482-1-071-.17], which sets forth the required disclosure provisions for all Medicare supplement policies and certificates.  The amendments will make the section substantially similar to the most recent revisions of the NAIC model regulation.  The amendments will become effective January 1, 2020.  (47 pages)

 

Amendments to Section 19 of Insurance Regulation No. 71 [Rule 482-1-071-.19], which provides the filing requirements for advertising of Medicare supplement insurance.  The amendments correct a typographical error and remove the transitory provision from 2010.  The amendments will become effective June 24, 2017.  (2 pages)

 

Amendments to Section 6 of Insurance Regulation No. 110 [Rule 482-1-110-.06], which sets forth the requirements applicable to continuing education providers.  The amendments alter the third party proctor requirements for the examination following completion of a correspondence or internet course.  The amendments will become effective June 24, 2017.  (4 pages)

 

Amendments to Section 4 of Insurance Regulation No. 138 [Rule 482-1-138-.04], which sets forth the requirements for captive insurance companies to file an annual audit conducted by an independent certified public accountant.  One amendment increases the annual premium limit within which certain captive insurers can request to be exempt from this requirement from $1,200,000 to $2,200,000.  Another amendment permits captive risk retention groups to apply for an exemption upon certain circumstances.  The amendments will become effective June 24, 2017.  (5 pages)

 

Amendments to Section 3 of Insurance Regulation No. 159 [Rule 482-1-159-.03], which sets forth the eligibility limits to receive grants from the Strengthen Alabama Homes program.  The amendments change the percentage of family income thresholds and increase the maximum grants available through the program.  The amendments will become effective June 24, 2017.  (2 pages)

 

Amendments to Section 4 of Insurance Regulation No. 159 [Rule 482-1-159-.04], which sets forth the grant award allocations percentages for grants from the Strengthen Alabama Homes program.  The amendments change the percentage of family income thresholds relative to the percentage of grants to be awards.  The amendments will become effective June 24, 2017.  (2 pages)

 

Amendments to Section 1 of State Fire Marshal Regulation No. 101 [Rule 482-2-101-.01], which adopts the 2013 edition of the National Fire Codes®, with exceptions.  The amendments correct a typographical error and add NFPA 5000 to the list of those portions not adopted.  The amendments will become effective June 24, 2017.  (2 pages)
